Parties to this Agreement

This Pet Sitting Service Agreement ("Agreement") is entered into between Elie's Bird Sitting ("Service Provider," "Elie") and the client identified in the signature block below ("Client," "Pet Owner"). Together referred to as "the Parties."

This Agreement governs all bird sitting and related pet care services provided by Elie's Bird Sitting at the Client's residence or as otherwise agreed.

1. Services Provided

Elie agrees to provide the following services as specified in the confirmed Bird Care Profile form submitted by Client:

  1. In-home pet sitting visits of agreed duration and frequency
  2. Feeding, watering, and supplement administration per written instructions
  3. Cage cleaning, substrate change, and enrichment interaction
  4. Out-of-cage time and handling, if authorized by Client
  5. Medication and treatment administration, if applicable and agreed in writing
  6. Home security duties (mail collection, light rotation) if specified
  7. Daily photo/update reports sent via agreed communication channel

Services not listed in the Bird Care Profile or this Agreement may be subject to additional charges and must be confirmed in writing prior to the service period.

2. Service Rates & Payment

Payment is due in full before the first visit unless a prior written arrangement has been made. Accepted payment methods: . does not accept cash or checks.

3. Cancellation Policy

  1. Cancellations 7+ days before service start: Full refund.
  2. Cancellations 3–6 days before service start: 50% refund.
  3. Cancellations fewer than 72 hours before service start: No refund. The full fee is retained to compensate for the reserved time.
  4. Holiday period cancellations (within 7 days): No refund.
  5. Elie reserves the right to cancel services with full refund in cases of emergency, serious illness, or circumstances beyond her control. Client will be notified immediately and reasonable efforts made to arrange alternative care.

4. Emergency Medical Authorization

In the event of a medical emergency involving Client's bird(s), Elie is authorized to seek veterinary care from the Client's named veterinarian (or the nearest available avian emergency clinic if the named vet is unavailable).

Elie will make every reasonable effort to contact Client before authorizing treatment. In the event Client cannot be reached, Elie may authorize emergency care up to the dollar amount specified and agreed to in the Bird Care Profile. All veterinary costs are the sole responsibility of the Client. A specific authorization limit is required of all clients — it is a condition of service.

Client acknowledges that birds can deteriorate quickly and that delayed treatment may be fatal. Elie's judgment in emergency situations, made in good faith, shall not be grounds for any claim against her.

5. Liability & Limitation of Liability

Elie's Bird Sitting carries professional liability insurance and a surety bond through the National Association of Professional Pet Sitters (NAPPS). Client agrees to the following limitations:

  1. Elie shall not be held liable for injury, illness, death, or loss of a pet resulting from undisclosed health conditions, behavioral tendencies, or pre-existing conditions.
  2. Elie shall not be liable for escape, injury, or death resulting from faulty or inadequate caging, clips, or enclosures provided by Client.
  3. Elie shall not be liable for damages to Client's property caused by the bird(s) in the normal course of care.
  4. Elie's total liability to Client for any single incident is limited to the total amount paid for the relevant service period.
  5. Client agrees to hold Elie harmless from any third-party claims arising from injuries caused by Client's bird(s).

6. Client Representations & Warranties

Client warrants and represents that:

  1. All information provided in the Bird Care Profile is accurate, current, and complete to the best of Client's knowledge.
  2. All birds are legally owned by Client or Client has full authority to arrange care for them.
  3. All birds are current on any required health certifications; Client will inform Elie of any zoonotic disease diagnosis immediately.
  4. The home environment is reasonably safe and will be disclosed regarding potential toxins (Teflon/PTFE, scented candles, air fresheners, certain plants).
  5. Client has disclosed all known behavioral issues, including aggression, previous bites, phobias, or stress triggers.

7. Entry & Key Policy

Client authorizes Elie to enter the home for the sole purpose of providing the agreed services. Keys, access codes, and security information will be held in strict confidence, secured appropriately, and returned promptly at the conclusion of services unless Client requests Elie retain them for future bookings.

Elie will never share access information with any third party. In the event of a lock-out or security issue, Elie will contact Client immediately.

8. Communication & Updates

Elie will provide at least one photo update per visit via the Client's chosen communication channel (text, email, or app). Clients may contact Elie at any time during the service period and can expect a response within 2 hours during waking hours.

In case of emergency, Elie will make repeated contact attempts. If Client cannot be reached, Elie will contact the designated Emergency Contact on file.

9. Privacy

Elie's Bird Sitting will not share Client personal information, address, access information, or bird/pet details with any third party except as required by law or as necessary for emergency veterinary care. With prior written consent from Client, Elie may share photos of Client's birds on her website or social media for marketing purposes.

10. Photographing & Social Media

Elie may photograph birds in her care for professional documentation purposes. Public use of images requires Client's explicit written consent.

11. Termination

Either party may terminate this Agreement with 24 hours' written notice. In the event Elie terminates services due to Client's breach (including, but not limited to, providing false information about a bird's health or behavior), no refund will be issued. Elie reserves the right to contact Animal Control if she reasonably believes a bird is suffering from neglect or abuse.

12. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Arizona. Any dispute arising from this Agreement shall first be submitted to mediation. If mediation fails, disputes will be resolved in the courts of Maricopa County, Arizona. The prevailing party shall be entitled to reasonable attorney's fees.

13. Entire Agreement & Modifications

This Agreement, together with the Bird Care Profile form, constitutes the entire agreement between the Parties. No modification is effective unless made in writing and signed by both parties. Prior agreements, representations, or warranties are superseded by this document.
